Madras HC hears Vijay’s appeal against judge’s scathing remarks in Rolls-Royce Ghost case – India Today

The Madras High Court heard Tamil actor Vijay’s appeal regarding the order passed by a single judge, Justice SM Subramaniam, dismissing his plea for seeking tax exemption for his 2012 Rolls-Royce Ghost. Vijay’s appeal seeks the expunging of scathing remarks made by SM Subramaniam while asking to set aside Rs 1 lakh, which was to be deposited into the Tamil Nadu Chief Minister’s Covid-19 Relief Fund as a fine.

On July 13, Vijay was fined Rs 1 lakh by the Madras High Court for his petition seeking exemption of tax on his imported car, the Rolls-Royce Ghost. Now, the Madras High Court is hearing the Master actor’s appeal regarding the order passed by a single bench, SM Subramaniam.

Vijay’s legal team in their appeal have submitted that Justice SM Subramaniam made unjust remarks against Vijay and the acting community at large when he said that ‘in Tamil cinema, heroes have become rulers, prompting people to believe them as real heroes’. SM Subramaniam also criticised Vijay’s actions, claiming the ‘reel heroes take on corruption in cinema but act differently in real life’.

The legal team was of the opinion that though SM Subramaniam has dealt with other cases involving luxury cars with one-page orders, in Vijay’s case, he made derogatory remarks.

Through their appeal, they are looking at a Supreme Court precedent in the Rolls-Royce Ghost case.

According to the legal team, Vijay is ready to pay the ‘Entry Tax’ on his Rolls-Royce Ghost but every citizen is entitled to avail legal remedies to challenge the imposition of tax. But to make derogatory remarks against a petitioner for availing a legal remedy is unjust.

The appeal also shed light on how SM Subrahamaniam ’s remarks have cast aspersions on Vijay, labelling him as an anti-national and has also cast aspersions on the whole acting community.

VIJAY FINED RS 1 LAKH OVER TAX EXEMPTION OF HIS ROLLS-ROYCE GHOST

Vijay was fined Rs 1 lakh by the Madras High Court over his petition seeking exemption of tax on his imported car, a Rolls-Royce Ghost, which was imported from England.

Vijay’s contention in court was that extraordinary Entry Tax on an imported vehicle had been imposed and, since he could not use it without a valid registeration certificate, he approached the court seeking exemption from payment.

Justice SM Subramaniam dismissed the petition and asked Vijay to deposit Rs 1 lakh to the Tamil Nadu Chief Minister’s Covid-19 Public Relief Fund within two weeks from the date of receipt of a copy of the order. He also asked the Bigil actor to pay the tax due within a two-week period.
